Definitions
Europe’s Energy Portal is an organization founded under Dutch law.
These terms and conditions are also referred to as 'terms of use', as a usage description is integrated into the terms. Europe's Energy Portal is also referred to as 'Energy.eu or 'EEP'.
Legal entities who buy products or services from Europe's Energy Portal are referred to as clients.
Europe’s Energy Portal researches and publishes energy price data and energy statistics covering the member states of the European Union. For questions regarding these terms, please contact Europe’s Energy Portal.
§1 - PUBLIC DATA

Public Energy Data is all data that is publicly accessible to visitors of Europe's Energy Portal.

Public Energy Data may not be reproduced or redistributed, or used commercially, without written consent from Europe's Energy Portal.

Free energy reports are available in the publications section. Europe's Energy Portal is not responsible for reports produced by third-party authors. The reports are in PDF-format and may contain documentation from various authors.

With respect to all data contained on Europe’s Energy Portal website (www.energy.eu), neither Europe's Energy Portal, nor any of its employees or contractors make any representations or warranties, express, implied, or statutory, as to the validity, accuracy, completeness, or fitness for a particular purpose; nor assume any liability resulting from the use of such data and shall in no way be liable for any costs, expenses, claims, or demands arising out of the use of such data.

§2 - COMMERCIAL DATA

Commercial Energy Data are data products or reports produced by Europe's Energy Portal upon request by its clients.
|

2.1

TERMS OF DELIVERY
|
|
2.1.1
| The payment term for ordered products and/or services is 30 days net from the date of invoice.
Within two working days after receiving payment, the ordered product(s) shall be delivered. Products that are not readily available, e.g. researches carry a delivery term that is indicated on the invoice.

|
For subscription based Commercial Energy Data, the minimum subscription duration is 6 months. Cancellations must be forwarded via e-mail at least one month before the end of the subscription period.

2.1.3
|
Europe’s Energy Portal delivers its Commercial Energy Data products in Microsoft Excel format via e-mail and/or Europe’s Energy Portal makes its data accessible by granting exclusive access to a secured website. Reports are produced in PDF format.

2.1.4
| Commercial Energy Data under subscription, is delivered at the end of each month, unless another date is communicated. In the event in which data gathering and processing was not finished before the date due, datasets are transmitted within one week of the date originally communicated.

|
Commercial data may differ from data that is publically available on the website and from sample data that is provided to a client.

2.2
|
TERMS OF USE
|

2.2.1
|
Europe's Energy Portal does not grant exclusive use rights with respect to Commercial Energy Data, unless otherwise agreed upon with the client.
|
|
2.2.2
|
Commercial Energy Data is intended for the sole use by the client or site-specific use by the client's organization, e.g. Intranet. The following statement must be added for site-specific use of Europe's Energy Portal commercial energy data:

The client may not reproduce Commercial Energy Data for distribution to any third party, unless otherwise agreed with Europe’s Energy Portal. Please contact licensing for a license agreement.

2.2.4
|
If any modification to Commercial Energy Data is made by the client or client's organization, a statement must be added acknowledging that modifications were made, identifying client or client's organization as originator of the modifications, and including the date of the modifications and a general description of the modifications.

2.3
|
GENERAL
|

2.3.1
|
This Agreement is governed by and interpreted under the laws of the Kingdom of the Netherlands. Any controversy or claim arising out of or relating to this Agreement or the provision of services or products shall be settled by a court of law, located in the Kingdom of the Netherlands.

|
With respect to data contained in the commercial energy product, neither Europe's Energy Portal, nor any of its employees or contractors make any representations or warranties, express, implied, or statutory, as to the validity, accuracy, completeness, or fitness for a particular purpose; nor assume any liability resulting from the use of such data and shall in no way be liable for any costs, expenses, claims, or demands arising out of the use of such data.
